Welcome to HYVOR! These Terms of Service ("Agreement") govern your access to and use of
HYVOR's services, including authentication services and all products we provide. By using
our services, you agree to be bound by this Agreement as well as the product-specific terms
listed below:
In the event of any conflict between this Agreement and the product-specific terms, the
terms on the specific service page will prevail.
1. DEFINITIONS
- "Account": This refers to a personal account created by an individual
human user. This account allows the user to access HYVOR's services. Each account is
unique to a single user and contains their personal information, login credentials, and
other relevant data.
- "Agreement": This is the Terms of Service document itself. It
represents the legal contract between HYVOR and the user, outlining the rules and
guidelines for using HYVOR's services.
- "Service": This refers to all applications and functionalities hosted
at hyvor.com, including both the general authentication services and any specific
products offered. It encompasses the entire suite of tools and features provided by
HYVOR.
- "Product": A "Product" is a specific SaaS (Software as a Service)
offering provided by HYVOR. Examples include Hyvor Talk (a commenting platform) and
Hyvor Blogs (a blogging platform). Each product may have its own specific terms of
service in addition to the general terms.
- "User", "You", "Your": Any individual or entity that uses HYVOR's
services. This can include anyone from individual users to organizations that make use
of HYVOR's products and features.
2. ACCOUNT TERMS
- Accounts must be created by human individuals only. Automated systems, bots, and scripts
are not allowed to create accounts.
- You must provide a valid email address and a username during the account creation
process. Additional information is optional, but you will need to provide your name and
address for billing purposes if you choose to upgrade to a paid plan.
- You must be at least 15 years old to create an account and use our Service, in
compliance with European laws.
- Login credentials are to be used by one person only. Sharing your login credentials with
others is prohibited.
- Users must not violate the export laws of France or the European Union. This includes
restrictions on software, technology, and services.
- While we offer security features such as TOTP-based Two-Factor Authentication (2FA), the
security and usage of your account is your responsibility. You must maintain the
confidentiality of your login credentials (email, password, etc.). HYVOR is not liable
for any loss or damage resulting from unauthorized access to your account.
- You are responsible for any content generated, uploaded, or shared from your account.
This includes ensuring that your content complies with our content policies and does not
infringe on the rights of others.
- You are responsible for all activities that occur under your account. If you suspect any
unauthorized use of your account, you must notify us immediately.
- You may not use your account for any illegal or unauthorized purpose. You must not, in
the use of the Service, violate any laws in France or your jurisdiction, including but
not limited to copyright laws, trademark laws, export control laws, and privacy laws.
- HYVOR reserves the right to suspend or terminate your account
at any time, with or without notice, for conduct that we believe violates this Agreement
or is otherwise harmful to other users, third parties, or our business interests. See the
section for more details.
- Your use of the Service is also governed by our Privacy Policy,
which outlines how we collect, use, and protect your personal data in compliance with
GDPR and other applicable data protection regulations.
3. COPYRIGHT INFRINGEMENT
HYVOR respects the intellectual property rights of others and expects its users to do the
same. If you believe that your copyrighted work has been copied in a way that constitutes
copyright infringement and is accessible on the Service, please notify us immediately by
sending an email to [email protected]. We will respond to
all such notices, including as required or appropriate by removing the infringing material
or disabling all links to the infringing material. We will
terminate a user's access to and use of the Service if, under appropriate
circumstances, the user is determined to be a repeat infringer of the copyrights or other intellectual
property rights of HYVOR or others.
4. TRADEMARK AND INTELLECTUAL PROPERTY
- "HYVOR" is a registered trademark in Europe. The trademark covers the name
"HYVOR" and any associated logos, symbols, or marks used to identify our products and services.
- You may use HYVOR logos only in accordance with our branding guidelines. Any use of our
logos must be for the purpose of identifying our products or services and must not imply
any endorsement or partnership without our express written consent.
- Any authorized use of our logos or branding materials must maintain the integrity and
distinctiveness of the HYVOR brand and should not be altered or misrepresented in any
way.
5. CANCELLATION AND TERMINATION
- It is the user's responsibility to cancel their account if they no longer wish to use
our Service. Account cancellation can be done by visiting https://hyvor.com/account and selecting the option to delete the account. We do not accept cancellation requests
through email or any other methods.
- Upon cancellation of your account, we will delete your data and account in accordance
with our account deletion policy as described in our documentation.
- HYVOR reserves the right to terminate your account, with or without cause, at any time
and without prior notice. Reasons for termination may include, but are not limited to,
violation of this Agreement, failure to pay applicable fees, or conduct that is harmful
to other users, third parties, or our business interests.
- In the event of termination by HYVOR, you will lose access to your account and any data
associated with it. We may also restrict you from accessing our Service in the future.
- Unless otherwise stated in our refund policy, termination of your account will not
entitle you to any refunds of fees paid.
- The termination of your account does not relieve you of any obligations or liabilities
incurred prior to termination, including but not limited to payment obligations,
warranty disclaimers, and limitations of liability set forth in this Agreement.
6. MISCELLANEOUS
6.1 Changes to the Agreement
HYVOR reserves the right to modify this Agreement at any time. We will notify you of any
changes by posting the updated terms on this page. You are advised to review this Agreement
periodically for any changes. Changes to this Agreement are effective when they are posted
on this page.
6.2 Indemnification
You agree to indemnify and hold HYVOR, its affiliates, officers, agents, and employees
harmless from any claim or demand made by any third party due to or arising out of your use
of the Service, your violation of this Agreement, or your violation of any rights of another
party.
6.3 Warranty Disclaimer
You agree that your use of the Service is at your sole risk. The Service is provided on an
"as is" and "as available" basis. HYVOR disclaims all warranties of any kind, whether
express or implied, including but not limited to the implied warranties of merchantability,
fitness for a particular purpose, and non-infringement.
6.4 Limitation of Liability
In no event shall HYVOR, its directors, officers, employees, or agents be liable for any
direct, indirect, incidental, special, or consequential damages arising from your use of the
Service or any products procured using the Service. This includes, but is not limited to,
damages for loss of profits, data, or other intangible losses resulting from the use or
inability to use the Service.
6.5 Governing Law
This Agreement is governed by the laws of France, without regard to its conflict of law
principles. Any dispute arising from this Agreement shall be resolved in the courts of
Paris, France.
